definition, Collaborative
Divorce is a voluntary legal process which enables separating
couples to end their marriage through the mediation process.Couples work with their
lawyers and occasionally, other family professionals in order to avoid the
uncertain outcome of a contested and often costly litigation process. Parties,
through their lawyers, work hand in hand to address and achieve a global settlement
that best meets their specific needs and that of their children.
The Collaborative Divorce
Process is founded on the following principles:
- A pledge not to litigate in Court.
- An openly honest and voluntary approach to the exchange of information.
- A commitment to work towards solutions that take into account the highest priorities of both parties and their children.
The process can be used to
address all of the issues addressed under the traditional divorce process, such
as:
- Child custody care and control, child access
- Spousal and child maintenance
- Division of matrimonial assets
- Taxes
- Insurance
- Divorce grounds
After
successful mediation and subsequent agreement on terms, parties engage their
lawyers to file their Separation as an Uncontested Divorce on a fault (adultery,
unreasonable behaviour) or no-fault basis (3 year separation).
