You may leave your estate directly to your minor children. However, before they reach the age of 21 years old, any such inheritance will be managed by a custodian. This custodian is usually either the surviving parent or the guardian.

Should you wish to provide for your children over an extended period of time, a trust for your children can be incorporated into your will. Through the assistance of your Singapore wills lawyer, the inheritance will then be held by a trustee for your children until such time when they reach 21 years old, or whatever age you deem appropriate. The trustee may also be empowered to use a certain portion of your estate for your children’s education, medical expenses and/or maintenance according to your instructions. Your wills lawyer will be able to advise you on this process.

In leaving your assets to your minor children, it is also recommended that you name at least two Executors/Trustees in case one of them is unable to act for whatever reason. These Executors/Trustees would then be able to administer or hold any assets, or utilize any monies for the benefit of the minor children.

Why make a will?

A will or testament is a legal declaration made by a person on how his/her property should be divided upon their demise. An individual may dispose of both real and personal property in his will.

A will allows an individual to distribute his/her property to be distributed according to their wishes. It is used also to safeguard a person’s right to select an individual to serve as guardian to raise his young children upon their death. If an individual passes away in Singapore without a will, his or her estate may be distributed to people to whom he never intended to leave anything to.

Why should you employ a Singapore Wills Lawyer to construct your will?

When making your own will, there is an inherent risk that a self-made will may be ineffective or invalid due to irregularities and absence of clauses. This may well result in the will being contested in the future. To ensure that your will is effective and passes on your wishes, you should seek the services of a Singapore Will Lawyer who can aid in drafting your will in accordance to the requirements of the law.

When should one review his will?

-When a personthat is named in the will changes their name by deed pol

-If an executor becomes incapable of carrying out his/her duties owing to ill-health or upon their death
